Lexerta respects the privacy of all users of its site and services, and ensures that the personal information you provide to us is used and deleted with care and in accordance with laws and regulations.

Use of our services

When you use our services, we ask you to provide personal data. This data is used to be able to carry out our services. The data is stored on Lexerta's own secure servers or those of a third party. We do not combine this data with other personal data that we possess. Services include:

• Sending information by email, such as newsletters, offers, and/or promotions;
• The creation and execution of concluded agreements, such as handling orders, performing services, and sending products purchased from Lexerta.

Communication

When you send us email or other messages, it is possible that we retain those messages. Sometimes we ask you for personal data that is relevant to the particular situation. This makes it possible to process and answer your questions.

We will, of course, not use the data you provide for purposes other than those for which you have provided it.

Security measures

Lexerta has taken appropriate technical and organizational measures to secure your personal data as much as possible against loss, unlawful use, unlawful processing of your personal data by others, and also to prevent unauthorized access to your personal data. Lexerta does this, among other things, through physical (access) security and the use of passwords. These measures are regularly checked for vulnerabilities by a professional third party and are supplemented or tightened if necessary. We collect data for research in order to gain better insight into our customers, so we can tailor our services accordingly.

This website uses “cookies” (text files placed on your computer) to help analyze how users use the site. The information generated by the cookie about your use of the website may be transferred to Lexerta's own secure servers or those of a third party. We use this information to track how you use the website, to compile reports on website activity, and to offer other services relating to website activity and internet usage.

In the context of our services or because you have provided this data to us, we process the following personal data.

• Phone number;
• Email address;
• Chamber of Commerce number and VAT number;
• Gender.

Lexerta only processes personal data if there is a legal basis for doing so, as prescribed in the General Data Protection Regulation. The following legal bases apply:

1. Execution of agreements

This applies to personal data that we process from clients, subcontractors, and suppliers with whom we have concluded an agreement in the context of, but not limited to, the development and sale of our services.

2. Legitimate interest

Lexerta has a legitimate interest in recruiting customers and maintaining relationships by collecting personal data.

3. Compliance with legal obligation

Lexerta is required to process personal data due to a number of legal obligations, such as the Fiscal Retention Obligation, the Collection Act 1990, the Foreign Nationals Employment Act, and the Identification Act.

Third parties

The information you provide to us is, in principle, not shared with third parties. We do share the information, albeit limited, with our partners such as the web applications and ICT parties that we use for our services. This data is only used for the purpose of the service and is not further distributed. Furthermore, in some cases, the information may be shared internally. Our employees are required to respect the confidentiality of your data. For parties we collaborate with, good agreements have been made about their obligations and powers, and these have been recorded in (processing) agreements where applicable.

In addition, we may provide personal data to a third party, such as a regulator or another authority with public authority, insofar as there is a legal obligation to do so.

With the third party that processes your personal data on behalf of and by order of Lexerta, a processing agreement is concluded, whereby that third party is also obliged to comply with the GDPR. Third parties engaged by Lexerta who offer services as data controllers are themselves responsible for compliance with the GDPR for the (further) processing of your personal data.

This privacy statement only applies to the Lexerta platform and not to other third-party websites for which a link is shown in the Lexerta platform. If you arrive at another website via a hyperlink, this privacy statement does not apply to your visit to that website. We advise you to carefully read the privacy policy of third-party websites.

How long do we keep your personal data?

We do not retain your data longer than necessary to achieve the purposes mentioned in this privacy statement.

• The retention period for our administration is seven years, in accordance with the legal obligation. This includes the agreements concluded with you, and the period starts after the agreement has ended.
• If you send us an email or submit a question via a contact form, the data you send us will be kept for as long as necessary, given the nature of the form or the content of your email, for the complete response and handling thereof.
• Data for marketing activities is kept for a maximum of 1 year after there has been contact in the context of offering products or services.

This privacy statement is tailored to the use of and possibilities on this site. Any adjustments and/or changes to this site may lead to changes in this privacy statement. It is therefore advisable to consult this privacy statement regularly.

Access, modification, restriction of personal data or a complaint

If you want to know what personal data Lexerta collects and uses about you, you can submit a request for this. You also have the right to:

• Correct or delete your personal data;
• Withdraw your consent for data processing
• Object to the processing of your personal data by Lexerta
• Data portability; this means that you can submit a request to us to send the personal data we have about you in electronic form to you or another organization you specify.

If, despite our efforts, you believe that we are processing your personal data in a careless or unlawful manner, or if, for example, we do not respond adequately to your request, you can contact the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) and file a complaint. Of course, we hope you come to us first so that we can look for a solution together.
